1. Acceptance of Terms

By accessing or using metrianutrition.com (the "Site") or purchasing products from Metria Nutrition ("Metria," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site or purchase our products.

These Terms incorporate by reference our Privacy Policy, Cookie Policy, Supplement Disclaimer, and Guarantee Policy.

2. Eligibility

You must be at least 18 years old to purchase from the Site or create an account. By using the Site, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Accounts

If you create an account, you are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use or security breach at support@metrianutrition.com

You may close your account at any time by contacting us. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Orders, Pricing, and Payment

• All orders are subject to acceptance and product availability
• Prices are listed in U.S. dollars and may change without notice
• We reserve the right to refuse, cancel, or limit any order, including for suspected fraud, pricing errors, or violations of these Terms
• You authorize us to charge your selected payment method for the total order amount, including taxes and shipping
• All sales are subject to our 60-Day Empty Bottle Guarantee

5. Subscriptions and Auto-Renewal

Important: please read this section carefully.

If you choose a Subscribe & Save option, you are enrolling in a recurring subscription that will automatically renew until canceled. By enrolling, you acknowledge and agree to the following:

Auto-renewal terms:

• Your subscription will automatically renew at the interval you selected (e.g., every 30, 60, or 90 days)
• Each renewal will be charged to your selected payment method at the then-current subscription price
• You will receive an email reminder before each renewal shipment
• Subscription prices include the advertised Subscribe & Save discount

How to cancel:

• You may pause, skip, or cancel your subscription at any time
• Cancellations made at least 24 hours before your next scheduled shipment apply to that order
• Cancellations made less than 24 hours before a shipment apply to the following order
• You can cancel from your account dashboard or by emailing support@metrianutrition.com
• No cancellation fees. No phone calls required. No "retention" hoops.

By starting a subscription, you acknowledge that you have read and accepted these auto-renewal terms.

6. Shipping and Delivery

Shipping options, delivery timelines, and international rates are described on our Shipping & Delivery page. All shipping and delivery terms are incorporated by reference into these Terms.

We are not responsible for delays caused by shipping carriers, customs, or events beyond our reasonable control.

7. Returns and Refunds

Returns and refunds are governed by our 60-Day Empty Bottle Guarantee. The guarantee applies to your first bottle of any order, regardless of bundle size, opened or unopened. Sealed additional bottles from bundles are refundable at the bundle per-bottle rate.

8. Product Information and Health Disclaimer

Statements regarding dietary supplements have not been evaluated by the U.S. Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.

You may not reproduce, distribute, modify, or create derivative works of any Site content without our prior written permission.

You may share links to our Site for non-commercial purposes, provided you do not modify our content or imply endorsement.

10. User Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law
• Attempt to interfere with, disrupt, or impair the Site's operation
• Use automated systems (bots, scrapers, etc.) to access the Site without our written permission
• Misrepresent your identity or impersonate any person or entity
• Attempt to gain unauthorized access to any portion of the Site, our systems, or other users' accounts
• Use the Site to transmit viruses, malware, or other harmful code
• Reverse engineer, decompile, or attempt to extract source code

We reserve the right to investigate and take legal action against any violation of these Terms.

11. Disclaimer of Warranties

THE SITE AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, METRIA NUTRITION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any specific results will be achieved from the use of our products. Individual results vary.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, METRIA NUTRITION AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR PRODUCTS.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE OR PRODUCTS IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Metria Nutrition and its officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your violation of these Terms
• Your misuse of our products
• Your violation of any rights of a third party
• Your violation of any applicable law

14. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or related to these Terms or your use of the Site or our products shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

The arbitration will be conducted in Delaware or via videoconference. Each party will bear its own costs and attorneys' fees, except as required by AAA rules.

Class action waiver: You agree that any arbitration or legal proceeding will be conducted only on an individual basis and not as a class, collective, or representative action.

Exceptions: Either party may seek injunctive relief in court to protect intellectual property rights or address violations of these Terms.

Opt-out: You may opt out of this arbitration agreement within 30 days of first agreeing to these Terms by emailing support@metrianutrition.com with the subject line "Arbitration Opt-Out."

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Subject to the arbitration provision above, any disputes not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Supplement Disclaimer, and Guarantee Policy, constitute the entire agreement between you and Metria Nutrition regarding your use of the Site and purchase of our products, and supersede any prior agreements.

18. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date. Your continued use of the Site or purchase of our products after changes are posted constitutes acceptance of the revised Terms.
